A Study on Factors of Age Discrimination in the Employment: Review of Verdicts Made by The National Human Rights Commission of Korea

Abstract
There is an alarming increase in the age discrimination cases even though the Age Discrimination Prohibition Act was enacted in 2008. Most people has little doubt in discriminating the elderly in job posters, recruits, wages, promotions and layoff. Age discrimination in employment are attributed to negative stereotyping as well as the high wage as a result of seniority. The purpose of this study is to extract factors underlying age discrimination in employment by analyzing 52 cases investigated by the National Human Rights Commission of Korea. 44 concepts and 24 sub-categories and 5 categories are derived in the open-coding analysis of a grounded theory. Referring the previous studies, five categories are concluded as five discrimination factors: Economic, Prospect of long-term service, Generation conflict, Ageism and
Hierarchy factors. As Ageism is presented the most prominent and widespread factor, stereotypes and discriminative attitudes are confirmed to have great effects on age discrimination. The Hierarchy factor and the Prospect of long-term service are new factors when compared with the previous studies. Finally, The logics against these factors are summarized with terms and phrases extracted from verdicts made by the National Human Rights Commission.
